New trade mark, design laws in force in Bulgaria

With effect from 10 March 2011 Bulgaria has had a radically new system for trade mark registration.

Now, the Patent Office will only make an examination on absolute grounds and will no longer examine the existence of earlier rights. These changes in the law are based on EU legislation and copy the system of Community trade marks.

There is also a new system for design registration of a design. The Patent Office will no longer examine the presence of earlier designs or other intellectual property rights.

The new system for registration of designs, based on the Community design system, came into force on 12 February 2011.
