At the 75th session of the House of Representatives, held on April 7, 2010, and the 46th session of the House of Peoples, held on May 28, the Parliamentary Assembly of Bosnia and Herzegovina adopted the following laws:
- Trademark law
- patent law
- law on industrial designs
- law on the protection of indications of geographical origin
- law on the protection of topographies of integrated circuits
The essence of the new law on trademarks is that it is applied on as a system based on “opposition”. The procedure is as follows: first a trademark application must be filed, after that the patent office will examine the similarities in terms of identity / Article 6 of the law. When this two steps meet the requirements, it follows a publication in the official Gazette.
Objection can be filed in a period of 3 months.
If there is no objection, or the objection is being rejected, the applicant is supposed to pay the cost of maintenance fee after it gets the decision.
The recognized trademark is published in the official Gazette and a certificate is being given to the owner.
