Declaration made under Article 8(7)(a) of the Madrid Protocol and notification made under Rule 34(3)(a) of the Common Regulations
On July 2, 2019, the Government of Brazil deposited with WIPO the declaration indicating that Brazil wishes to receive an individual fee when it is designated in an international application, in a designation subsequent to an international registration and in respect of the renewal of an international registration in which Brazil has been designated (Article 8(7)(a) of the Madrid Protocol).
Together with that declaration, the Government of Brazil has notified WIPO that the individual fee in respect of a designation of Brazil is to be paid in two parts (Rule 34(3)(a) of the Common Regulations).
Those amounts will be:
- 105 Swiss francs (first part) and 188 Swiss francs (second part) for each class of goods or services, when designating Brazil in an international application or subsequently;
- 269 Swiss francs for each class of goods or services, when renewing an international registration in which Brazil has been designated; 406 Swiss francs where the payment is received within the period of grace.
The first part of the individual fee will have to be paid at the time of the designation of Brazil, either in an international application or as a subsequent designation. The second part will have to be paid only if the Office of Brazil is satisfied that the mark that is the subject of the international registration qualifies for protection, for all or some only of the goods and services concerned. Therefore, the payment of the second part will, if applicable, be required at a later date than that of the designation of Brazil.
This declaration shall have effect on October 2, 2019.
