Copyright Amendment Act 1983

An Act to amend the Copyright Act 1968

(Assented to 3 November 1983)

BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows: Short title, &c.

1. (1) This Act may be cited as the Copyright Amendment Act 1983.

(2) The Copyright Act 1968*1* is in this Act referred to as the Principal

Act.

2. This Act shall come into operation on a date to be fixed by Proclamation.

3. Section 47 of the Principal Act is amended-

(a) by omitting from sub-section (5) ”are delivered, with the consent of the National Librarian, to the National Library” and substituting ”are delivered, with the consent of the Director-General of the Australian

Archives, to the Australian Archives”; and

(b) by adding at the end thereof the following sub-section:

”(6) The Director-General of the Australian Archives shall not consent to the delivery to the Australian Archives in accordance with sub-section (5) of a record embodying a recording or of a copy of a film unless he has certified that the recording or film is of an exceptional documentary character.”.

4. Section 70 of the Principal Act is amended-

(a) by omitting from sub-section (5) ”are delivered, with the consent of the National Librarian, to the National Library” and substituting ”are delivered, with the consent of the Director-General of the Australian Archives, to the Australian Archives”; and

(b) by adding at the end thereof the following sub-section:

”(6) The Director-General of the Australian Archives shall not consent to the delivery to the Australian Archives in accordance with sub-section (5) of a copy of a film unless he has certified that the film is of an exceptional documentary character.”.

Making of record embodying sound recording for purpose of broadcasting

5. Section 107 of the Principal Act is amended-

(a) by omitting from sub-section (5) ”are delivered, with the consent of the National Librarian, to the National Library” and substituting

”are delivered, with the consent of the Director-General of the Australian Archives, to the Australian Archives”; and

(b) by adding at the end thereof the following sub-section:

”(6) The Director-General of the Australian Archives shall not consent to the delivery to the Australian Archives in accordance with sub-section (5) of a copy of a sound recording unless he has certified that the recording is of an exceptional documentary character.”.
