The Federal Government of Germany has meanwhile decided to extend the term of protection for artists and phonogram producers from 50 years to 70 years. With this draft bill, the Federal Government implements an EU directive of the year 2011.
This extension of the period of protection to 70 years concerns the right of recordings of performances of performing artists, such as for example musicians. The protection of audio recordings is thereby now extended to 70 years. The artists participate in the additional revenue of the phonogram producers by means of a claim for remuneration.
Additionally, with respect to music compositions with text, the period of protection of 70 years for composers and text writers is no longer calculated separately but uniformly after the death of the recently departed artist.
