As of February 1st 2014, the effects in French Polynesia of industrial property titles deposited renewed or extended at the INPI (National Institute of Industrial Property) shall be governed by the Extension Agreement signed between the Polynesian Government and the INPI.
Therefore, to be protected in French Polynesia, an industrial property title, filed (renewed or maintained) at the INPI, requires a claim of extension.
The titles that may be subject to a claim of extension are patents, utility certificates, trademarks (filed or renewed) designs (filed or maintained) and semiconductor “French” topographies governed by the Code of intellectual property.
However, the following are not affected by the extension agreement:
– Supplementary Protection Certificates (SPC)
– CTM (Community Trade Marks)
– The Community Designs
– The Titles of International Industrial Property
