At the beginning of 2011 a major court reform will become effective in Switzerlands. With the Patent Court Act, a national special court has been created which will be the only competent court for resolving disputes regarding patent law infringements and legalities. So far patent law infringement disputes have been resolved by courts of the 26 Swiss cantons.
As a lower court of the Federal Supreme Court, the new Swiss Patent Court will ensures the necessary specialist knowledge and effective legal protection for inventions. The court is comprised of both legal as well as technically-trained judges. The court will build synergies with the Swiss Federal Administrative Court in order to keep costs low. The court prrocedure essentially follows the Swiss Civil Procedure Code.
